The council was established by the Further and Higher Education (Scotland) Act 2005. It supersedes the two separate funding councils, the Scottish Further Education Funding Council (SFEFC) and the Scottish Higher Education Funding Council (SHEFC), which were established by the Further and Higher Education (Scotland) Act 1992. On its formation, the SFC acquired all employees and assets of those councils.:(Sch. 1 ss. 7–9)
